These Terms of Use (“Terms”) govern your access to and use of the websites, online products, and services (collectively referred to as the “Services”) provided by Kings House Brand LLC (“Kings House,” “we,” or “us”).
By clicking “I Accept,” selecting the agreement box, or using our Services in any manner, you agree to these Terms, including the mandatory arbitration provision and class action waiver outlined in Section 12. If you do not agree to these Terms, please refrain from using our Services.

1. Eligibility
To use our Services, you must be at least 18 years old. If you are under 18 (or the age of legal majority in your location), you may only access our Services under the supervision of a parent or legal guardian who agrees to be bound by these Terms. If you are a parent or legal guardian of a minor using our Services, you assume full responsibility for their actions. If you are using the Services on behalf of another person or entity, (a) all references to “you” in these Terms will include that person or entity, (b) you confirm that you have the authority to accept these Terms on their behalf, and (c) if a violation occurs, the entity or person you represent agrees to be held accountable.
2. Prohibited Conduct
(a) You must comply with all applicable laws, contracts, and intellectual property rights while using our Services. You are solely responsible for your behavior while engaging with our Services, including any products or services provided by third parties in connection with our platform. You agree not to:
- Engage in harassment, threats, intimidation, predatory behavior, or stalking;
- Use another user’s account without their authorization and approval from Kings House;
- Impersonate another person or entity or misrepresent your affiliation;
- Sell, resell, or exploit our Services for commercial gain;
- Copy, reproduce, distribute, publicly perform, or display our Services without explicit permission;
- Modify, remove proprietary notices, or create derivative works based on our Services;
- Use our Services in any way that disrupts, damages, or interferes with their functionality or other users’ experience;
- Reverse engineer any part of our Services or bypass security measures;
- Use automated tools like data mining or bots to extract data from our platform;
- Develop or integrate applications that interact with our Services without prior consent;
- Distribute spam, unsolicited messages, chain letters, or pyramid schemes;
- Ignore or bypass the instructions outlined in our robots.txt file;
- Engage in or promote any illegal or unauthorized activities in connection with our Services.
(b) You may not create, post, store, or share any content on the Services that violates these Terms.
Kings House reserves the right to enforce this section at its discretion. Failure to act on a violation does not constitute a waiver of our rights to do so in the future. Additionally, this section does not grant any third party the right to take legal action based on these prohibitions.
To assist parents and guardians in controlling access to harmful content for minors, various parental control tools and filtering services are available commercially. 3. Ownership and Limited License
Our Services, including text, graphics, images, videos, and other content, are owned by Kings House or our licensors and are protected under applicable laws. Except as explicitly permitted, all rights remain with us. We grant you a limited, nonexclusive, nontransferable, non-sublicensable, revocable license to access and use our Services solely for personal, non-commercial use. Any unauthorized use of our Services will result in termination of this license and may infringe on our intellectual property rights.
4. Trademarks
Kings House’s trademarks, service marks, logos, and branding associated with our Services may not be copied, imitated, or used without our prior written consent. Any mention of third-party trademarks remains the property of their respective owners and does not imply endorsement, sponsorship, or affiliation with Kings House.
5. Feedback
By submitting feedback, suggestions, or ideas (“Feedback”) regarding our Services, you grant Kings House the unrestricted right to use, modify, and implement such Feedback without acknowledgment or compensation. Feedback submissions will be considered non-confidential.
6. Third-Party Services
Our Services may include information about third-party products, activities, or services, including amenities, bookings, and reservations. Any engagement with third-party services is strictly between you and the respective third party. Kings House does not endorse or control these services and assumes no liability for your interactions with them.
Payments made through third-party processors are subject to their terms and conditions. Kings House is not responsible for any issues arising from transactions facilitated by external payment providers.
7. Indemnification
To the maximum extent permitted by law, you agree to indemnify, defend, and hold harmless Kings House and its affiliates, directors, officers, employees, and agents (“Kings House Parties”) from any claims, damages, expenses, or losses arising from: (a) Your use of the Services; (b) Your submitted Feedback; (c) Your violation of these Terms; (d) Your infringement of third-party rights; (e) Any misconduct in relation to the Services.
Kings House reserves the right to assume exclusive defense and control over any matter subject to indemnification. Your obligations under this section survive termination of these Terms.
8. Disclaimers
Our Services are provided “as is” and “as available” without warranties of any kind. We do not guarantee the accuracy, reliability, or security of the Services. Your use of any experiences offered through our Services is at your own risk. Kings House does not conduct background checks on users and is not responsible for interactions between users both online and offline.
9. Limitation of Liability
To the fullest extent permitted by law, Kings House and its affiliates are not liable for any indirect, incidental, consequential, or punitive damages, including lost profits or data loss, resulting from your use of the Services. Our total liability is limited to the greater of $50 or the amount you paid for our Services in the last six months. These limitations do not apply in cases of gross negligence, fraud, or intentional misconduct.
10. Release
To the extent permitted by law, you release Kings House and its affiliates from any claims, disputes, or damages arising from conflicts with other users or third parties. If you reside in California, you waive rights under California Civil Code § 1542, which states: “A general release does not extend to claims which the creditor does not know or suspect to exist in his or her favor at the time of executing the release, which if known by him or her must have materially affected his or her settlement with the debtor.”
11. Data Transfer and Processing
To provide our Services, you acknowledge and agree that we may process, transfer, and store your information in the United States and other countries. These locations may not offer the same legal protections as your local jurisdiction.
12. Dispute Resolution & Binding Arbitration
Please carefully review this section, as it requires you to resolve certain disputes and claims with Kings House through arbitration and limits how you may seek relief unless you opt out following the instructions below. This arbitration provision does not allow for class or representative actions. Arbitration also means you waive your right to sue in court or have a jury trial.
- No Representative Actions:
To the extent permitted by law, you and Kings House agree that any dispute related to these Terms or our Services will be addressed on an individual basis. Such disputes cannot be brought as class actions, class arbitrations, or any similar representative proceedings. - Arbitration of Disputes:
With the exception of small claims cases filed in the appropriate small claims court or disputes related to intellectual property rights, both you and Kings House waive the right to a jury trial and agree to resolve all disputes (including those related to privacy and data security) through binding arbitration administered by JAMS. If a dispute arises, you must first attempt to resolve it by sending a written notice to Kings House via email at [email protected] or by certified mail to 1560 E Route 66, Flagstaff, Arizona, US 86001, Attn: Dispute Notice. Your notice should include (i) your name and contact details, (ii) a description of the dispute, and (iii) the relief you seek. If no resolution is reached within 30 days, either party may proceed with arbitration under JAMS’ Streamlined Arbitration Rules. - Arbitration will be confidential and conducted before a single arbitrator in New York, unless you are a consumer, in which case you may opt for arbitration in your county of residence. The arbitrator will have the authority to grant any remedy available in court. You and Kings House agree that arbitration will be governed by the Federal Arbitration Act (FAA).
- Each party will maintain the confidentiality of arbitration proceedings unless disclosure is required by law. You and Kings House further agree that arbitration-related costs will be allocated as follows: If you initiate arbitration, you will pay a filing fee (up to $250 if you are a consumer), while Kings House will cover all other JAMS fees. If Kings House initiates arbitration, it will bear all associated fees. Any appeal or enforcement of an arbitration decision will fall under the jurisdiction of the state or federal courts of New York, New York.
- Any dispute must be filed within one year of its occurrence; otherwise, it is permanently barred.
- You have the right to opt out of binding arbitration within 30 days of first accepting this section. To do so, send a written opt-out notice to 1560 E Route 66, Flagstaff, Arizona, US 86001, Attn: Binding Arbitration Opt-Out, clearly stating your name, address, and intent to opt out. If you opt out, disputes will be resolved as outlined in Section 13.
- If any provision of this Section 12 is deemed unenforceable, the remainder shall still apply. However, if any claim must proceed as a class action or collective proceeding, it must be litigated in civil court rather than arbitration.
13. Governing Law & Jurisdiction
All disputes arising under these Terms or from the use of our Services will be governed by the laws of New York, excluding conflict of law principles. Any dispute not subject to arbitration or small claims court will be resolved in the state or federal courts of New York, New York.
14. Travel Advisory
Travel to certain destinations may involve greater risks. We recommend reviewing travel advisories from the U.S. government before booking international travel. Information on travel risks can be found at www.state.gov, www.tsa.gov, and other official sources. We are not responsible for the accuracy of information provided by these sites.
WE AND OUR SERVICE PROVIDERS DO NOT GUARANTEE THAT TRAVEL TO OR STAYS IN SPECIFIC DESTINATIONS ARE SAFE OR RISK-FREE. WE ARE NOT LIABLE FOR ANY DAMAGES OR LOSSES RESULTING FROM TRAVEL TO SUCH LOCATIONS.
15. Reservation Terms
Reservations made through our Services are subject to the following terms:

Cancellation policies, room rates, and other details vary by property and reservation type. These details will be displayed during booking.

If traveling with a pet, confirm the property’s pet policy in advance. Kings House is not responsible for property-specific pet policies.

Reservations of more than ten (10) rooms at the same property for the same dates must be booked directly through the property. We reserve the right to impose additional conditions on such bookings.

Requests for specific room features (e.g., bedding type, non-smoking rooms) are not guaranteed.

Special rates (e.g., AAA discounts) require proof of eligibility at check-in. Failure to provide proof may result in the standard rate being charged.
16. Modifications & Service Termination
We reserve the right to modify or discontinue our Services at any time. You may also stop using our Services at any time. We are not responsible for any losses resulting from your inability to access our Services.
17. Additional Terms & Amendments
Additional terms may apply to specific Services. If there is a conflict between these Terms and additional terms, the latter will govern.
We may update these Terms from time to time. If changes are made, we may notify you by email, through our Services, or by updating the “Last Updated” date. Unless stated otherwise, the revised Terms take effect immediately. Continued use of our Services after such notice constitutes acceptance of the changes. If you disagree with the revised Terms, you must discontinue use of our Services.
18. Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be severed, and the remaining provisions shall remain in effect.
19. General Terms
- Kings House’s failure to enforce any provision does not constitute a waiver of that provision.
- These Terms represent the entire agreement between the parties and supersede all prior agreements or understandings.
- Section headings are for convenience only and do not carry legal weight.
- The term “including” shall be interpreted as “including without limitation.”
- Communications and transactions between you and Kings House may be conducted electronically.
